The High Court in Nairobi upheld the impeachment of former Deputy President Rigathi Gachagua, ruling that Parliament acted within the Constitution but awarding him KSh50 million for violation of his right to a fair hearing during Senate proceedings. The court found that the Senate violated Gachagua's rights by failing to adjourn proceedings when he fell ill. Additionally, the court ruled that Deputy President Kithure Kindiki was properly nominated and that the National Assembly conducted adequate public participation during the impeachment proceedings. Lawyers have reacted strongly to the ruling, with some praising it as sound while others warned about the precedent set for constitutional rights. The Law Society of Kenya clarified that despite the impeachment, Gachagua remains eligible to run for president in 2027. The Senate plans to appeal the Ksh50 million damages award.
