The Ol-Kalou Land and Environment Court has issued a nationwide ban on planting eucalyptus trees within 30 meters of wetlands, ordering all existing trees in such areas to be uprooted within 45 days. This landmark ruling resulted from a public interest litigation filed by Nyamira-based lawyer Wilfred Moseti Omariba, pushing for stricter environmental regulations.
- The court also prohibited planting eucalyptus trees in marshy areas without written permission from the Water CS, on irrigated farmlands, where the water table depth is less than 20 meters, within 30 meters of infrastructure, on land parcels below a quarter acre, and in areas receiving less than 400 millimeters of rainfall annually.
- Parliament has been directed to formulate laws regulating eucalyptus tree planting within 12 months.
- Lawyer Omariba filed the suit four years ago against the Water and Environment Cabinet Secretaries, Kenya Forest Service (KFS), National Environment Management Authority (NEMA), and the Attorney General.
