The High Court has rejected a petition to overturn the nomination of Harold Kimuge Kipchumba by the ODM party to replace Treasury Cabinet Secretary John Mbadi in the National Assembly. Justice Lawrence Mugambi directed the case be referred to Chief Justice Martha Koome to gazette an election court for resolution.

• The petition, filed by Mary Arivisa Mwami, challenged Kipchumba's nomination as unconstitutional, citing an imbalance in the representation of people with disabilities.
• The Independent Electoral and Boundaries Commission (IEBC) defended the nomination, stating it followed legal provisions that reallocate vacant party list seats to the next qualified nominee of the same gender.
• Justice Mugambi emphasized that election disputes, whether by universal suffrage or party list nominations, must be heard by a specific election court as per the Constitution and Elections Act.
