The High Court in Eldoret has issued a landmark ruling recognizing the legal identity and constitutional rights of transgender persons in Kenya. This decision stems from a petition filed by a transgender woman, SC, who experienced degrading treatment while in state custody in 2019.

• SC was awarded Ksh1 million in damages for violations of her rights to dignity, privacy, and freedom from inhuman treatment.
• The court directed the government to enact a Transgender Protection Rights Act or revise the Intersex Persons Bill, 2024, to include legal recognition for transgender individuals.
• The Attorney General’s office was also directed to consider amending the Prisons Act to address vulnerabilities of transgender persons in police custody.
