This ruling stems from a property dispute where a land deal was deemed "misrepresentation and illegality" due to unclean title deeds and an attempt to evade stamp duty.

• The deal involved properties in Kisumu and Kajiado, with the lawyer, Mohammed Madhani, structuring the transaction through an SPV, Flynn Ltd, to avoid stamp duty.
• Justice Alfred Mabeya described the deal as “a calculated move to circumvent the law and extend to the plaintiffs the short end of the stick,” emphasizing that the court "cannot be made an instrument for enforcing an illegality."
