The IEBC returning officer for Malava constituency has disputed the withdrawal of Edgar Busiega, the Democracy for Citizens’ Party (DCP) candidate, from the upcoming by-election. Despite DCP's public announcement to support another candidate, Busiega did not follow due process, meaning he will still appear on the ballot on November 27.

• The IEBC returning officer, Salim Abdalla, confirmed that his office received no official withdrawal notice from DCP or Busiega.
• DCP had announced Busiega's withdrawal in favor of Seth Panyako of the Democratic Action Party-Kenya (DAP-K) to consolidate the United Opposition's support.
• In Kenya, candidate withdrawal requires a written notice to the returning officer at least three days before the election, signed by the candidate, and acknowledged by the IEBC.
