The court ruled that only the Public Service Commission (PSC) has the constitutional authority to establish offices, appoint public officers, and review terms of service, a mandate that cannot be overridden by the President.
The LSK argued that the President's order bypassed the PSC's constitutional role under Article 234, potentially leading to political interference in hiring decisions.
Justice Lawrence Mugambi emphasized that any attempt to reassign the PSC's constitutional functions, other than through delegation under Article 234 (5), is indefensible.
