The High Court has temporarily halted the establishment of the proposed National Infrastructure Fund, following a petition filed by the Consumers Federation of Kenya (COFEK). The conservatory orders will remain in effect pending a full hearing of the case.

On December 24, 2025, Milimani High Court Judge Bahati Mwamuye issued orders to stop the fund's establishment and operation.
Respondents, including the Office of the Auditor-General and the Office of the Controller of Budget, are restrained from acting on the fund.
The application is scheduled for a virtual hearing on January 20, 2026.
