Gachagua allegedly claimed on January 4 that money stolen in Minnesota, USA, was used to build the Eastleigh mall.
The lawyers representing the mall owners argued that Gachagua's remarks amount to ethnic vilification, implying collective culpability of the Somali community.
The complaint urges NCIC to determine if the remarks were hate speech, issue a censure, and recommend Gachagua for prosecution.
Eldas MP Aden Keynan criticized Gachagua, stating the mall was built on lawfully acquired land in 2009 and redeveloped between 2018 and 2022, making the fraud claim "chronologically impossible and factually inaccurate."
