The High Court of Kenya has dismissed a petition seeking disclosure of government expenditure on the late Raila Odinga’s unsuccessful bid for the African Union Commission (AUC) chairmanship, ruling the case was prematurely filed.

• The court upheld a preliminary objection from the Attorney General, stating the case should first be addressed by the Commission on Administrative Justice.
• The Attorney-General argued the information sought was protected under Section 6(1) and (2) of the Access to Information Act, pertaining to foreign relations, national security, and Cabinet deliberations.
• The petitioners, represented by lawyer Lemarks Suyianka and the African Centre for Peace and Human Rights, maintained the State's refusal violated Article 35 of the Constitution.
• Raila Odinga’s AUC bid was formally launched on August 27, 2024, and he toured 29 African nations.
