Cotu Secretary General Francis Atwoli and other newly-elected officials have received a court reprieve after the Labour Court and the High Court in Kerugoya declined to issue conservatory orders to remove them from office.

• The courts refused to block the Registrar of Trade Unions from registering or gazetting the elected officials, including Atwoli, pending the determination of two petitions.
• The petitions, filed by Fazul Mohamed and the Institute for Democratic Governance and Centre for Public Policy and Research, alleged premature elections and irregularities.
• Cotu argued that the elections were conducted lawfully, with over 90 percent quorum, and that the petitioners were not affiliated with the organization.
• Key unions such as KNUT, KUPPET, and KMPDU disowned the petition.
