Courts in Kenya will now prioritize mediation for burial and family disputes in a significant shift aimed at reducing court backlog and fostering family harmony.

All family-related cases, including custody, maintenance, matrimonial property, burial arrangements, and succession, will undergo mandatory screening within 30 days of filing and be referred to mediation unless exempted.
The resolutions were adopted at the 4th Annual Mediation Summit 2026, held at Strathmore University in Nairobi.
The initiative aims to promote quicker, more accessible justice and societal peace through amicable settlements, with plans for nationwide awareness campaigns and a dedicated Family Mediation Week.
