• Justice Gregory Mutai ruled that using the Railway Development Levy Fund (RDLF) before March 27, 2026, was unconstitutional.
• The direct procurement of China Road and Bridge Corporation (CRBC) and APEC Consortium without competitive tendering contravened the law.
• Despite approximately 40 percent completion, the court invalidated existing contracts and directed a new, compliant process within 90 days.
