The Employment and Labour Relations Court has certified as urgent a case challenging the appointment of James Mworia as the first Chief Executive Officer of the National Infrastructure Fund, allowing for an expedited hearing.

• The case highlights concerns about a potential conflict of interest, as Dr. Mworia was allegedly appointed CEO by the same six-member Board on which he was a sitting independent director.
• Petitioners, Javan Onyango and Emmanuel Kiplagat, are questioning the integrity of the recruitment process, including the short application window and lack of transparency in publishing applicant lists.
• The National Infrastructure Fund, established to mobilize up to Sh5 trillion for national infrastructure projects, faces scrutiny over its leadership selection.
