The High Court in Nairobi has upheld the impeachment of former Deputy President Rigathi Gachagua, ruling that Parliament acted within the Constitution when removing him from office. However, the court awarded Gachagua KSh50 million for a violation of his right to a fair hearing during the Senate proceedings, specifically finding that the Senate violated his rights by failing to adjourn when he fell ill. The court also affirmed that Deputy President Kithure Kindiki was properly nominated and that the National Assembly conducted adequate public participation during the impeachment process. Lawyer Ndegwa Njiru warned that lawyers would not stand by and watch the Courts allegedly preside over the funeral of Kenya's Constitution, while Lawyer Tom Ojienda lauded the judgment as sound. Lawyer Wangui had earlier asserted that Gachagua's right to a fair trial was compromised during the impeachment proceedings.
