Health Cabinet Secretary Aden Duale has stated his ministry will respect the High Court's decision to declare his months-old committee unconstitutional. On Wednesday, August 13, the High Court quashed the National Health Insurance Fund (NHIF) pending claims verification committee.

• The court ruled the committee's formation was unconstitutional, usurping powers of the Auditor General, contrary to Articles 226(3) & 229 of the Constitution.
• Justice Ruben Nyakundi stated CS Duale had no powers to form an Ad Hoc Committee.
• Duale affirmed the ministry would uphold the court's decision but would be guided by constitutional provisions and laws like the Public Finance Management Act 2012.
• Duale indicated that verification of pending claims is non-negotiable and the ministry will protect public resources, suggesting structural changes to align with the law.
