The High Court in Nairobi has temporarily stopped the Directorate of Criminal Investigations (DCI) from accessing confidential medical records from two private hospitals. This order is in connection with an investigation into the recruitment of Kenyans to fight in the Russian war.
The court order, issued by Justice Chacha Mwita, will remain in effect until October 8, 2025.
The DCI had demanded medical records of patients Vincent Odhiambo and Moogi Duncan, along with all patients whose bills were paid by international organizations in the last six months, from Universal Trends Medical and Diagnostic Center and Inspocare Health Limited.
The hospitals, represented by lawyer Danstan Omari, argued that the DCI's directive was unconstitutional and violated patient privacy under Articles 28, 31, and 43 of the Constitution.
