Court awards dues to police officer dismissed for firing gun while drunk..

The Employment and Labour Relations Court in Nairobi has ruled the dismissal of former General Service Unit (GSU) Constable Andrew Kyalo Mwanza unconstitutional, awarding him terminal dues despite his being fired for firing his gun while drunk.

Justice Hellen Wasilwa found that Mwanza's dismissal in July 2021 violated his rights due to rushed and unprocedural disciplinary proceedings.
Kyalo had admitted to firing six rounds from his service G3 rifle at Huruma Shopping Centre, Cheptais, on January 4, 2021, while intoxicated.
The court declined to reinstate Kyalo but directed that he be paid all terminal benefits from his dismissal date to the judgment date, plus costs.
