The High Court of Kenya has nullified President William Ruto's Executive Order No. 3 of 2024 concerning the management of State corporations. The court declared sections of the State Corporations Act unconstitutional for encroaching on the powers of the Public Service Commission (PSC).

• Justice Chacha Mwita ruled that sections 5(3) and 27(c) of the State Corporations Act are unconstitutional.
• The Executive Order, signed on May 24, 2024, aimed to centralize control over human resources and governance in State corporations under the Office of the President.
• The court affirmed that the President cannot exercise powers exclusively vested in the Public Service Commission under Article 234(2) of the Constitution.
