The land, designated for the expansion of Tom Mboya Avenue, was deemed fraudulently acquired by the Environment and Land Court.

The Land parcel Mombasa Island/Block XI/983 was recovered, valued at Sh21 million.
The Environment and Land Court Judge Stephen Kibunja ordered the cancellation of the fraudulently acquired title.
The land was irregularly allocated in January 1996 and later sold for Sh500,000 in 2003, with the original case filed in January 2008 by the former Kenya Anti-Corruption Commission (KACC).
