He termed the decision a “pyrrhic victory,” asserting that advisors will continue to offer guidance to President William Ruto.

The High Court ruled that the creation of advisors' offices and the appointment of 21 individuals were unconstitutional, citing a lack of legal basis and failure to consult the Salaries and Remuneration Commission (SRC).
Justice Bahati Mwamuye delivered the ruling, stating that the appointments bypassed the recommendatory role of the Public Service Commission.
Ndii was appointed on October 14, 2022, and stated that he can advise the President informally as a "kitchen cabinet over breakfast every morning."
