How a 1993 council decision handed prime public land to insiders...
✨ Key Highlights
The Ethics and Anti-Corruption Commission (EACC) has successfully recovered a Sh30 million parcel of public land in Machakos Town, which was fraudulently acquired by a former mayor in 1993. The land, originally designated for the Ministry of Health, was illegally subdivided during a council meeting.
- The recovered 0.395-acre parcel, valued at Sh30 million, was bequeathed by former Mayor Peter Muia to his son, Joseph Mutuku.
- The Machakos Plot Allocation Committee, of which Muia was a member, facilitated the illegal subdivision.
- The Environment and Land Court ruled that Mutuku obtained the title unconstitutionally, as the land was public property reserved for government housing.
- Justice Nelly Matheka, in her January 16 judgment, ordered the cancellation of Mutuku’s ownership and the removal of Family Bank’s Sh8 million charge over the parcel.
- Head of legal services and asset recovery unit David Too stated that EACC is pursuing recovery of assets valued at Sh363 million across Kitui, Machakos, and Makueni counties.
