• Senator Omtatah claims the agreement imposes mandatory co-investment obligations estimated at over Sh100 billion over five years, without legislative consent.
• The Executive is accused of binding future Parliaments and committing funds from the Consolidated Fund without proper appropriation, contrary to the Constitution and the Public Finance Management Act.
• Concerns are also raised regarding the sharing of health data, with Senator Omtatah questioning the adequacy of data protection measures and the lack of recourse for Kenyan citizens.
