Busia Senator Okiya Omtatah has petitioned the Judicial Service Commission (JSC) to remove three Court of Appeal judges over their handling of an appeal concerning the Kenya-US Health Cooperation Framework.

• The judges, Justices Kimaru, Munyao, and Okello, issued an order on May 12, 2026, staying High Court orders blocking the health deal.
• Omtatah accuses the judges of creating a constitutional crisis by withholding their written reasons for the stay until October 30, 2026, effectively blocking timely appeal to the Supreme Court.
