The High Court has upheld a decision allowing the testimony of slain businessman Jacob Juma to remain part of the court record in a pending criminal case, dismissing an appeal by the accused seeking to have it struck out.

Jacob Juma's testimony, given under oath in open court, will be considered in a case against businessman Samwel Bryan Yongo Otumba.
Otumba argued that his constitutional right to a fair trial was violated as he couldn't cross-examine Juma before his death.
The High Court ruled that the weight of Juma's testimony will be determined at the end of the trial, not at an interlocutory stage.
