The High Court has upheld the impeachment of former Deputy President Rigathi Gachagua but awarded him Sh50 million in damages. The court found that the Senate violated Gachagua's rights by failing to adjourn proceedings when he fell ill after he requested an adjournment due to ill health. Lawyer Tom Ojienda lauded the decision as sound, while Lawyer Wangui asserted that Gachagua's right to a fair trial was compromised during the impeachment proceedings. The High Court also ruled that National Assembly conducted adequate public participation during the impeachment process and that Kindiki was properly nominated as deputy president. Lawyer Ndegwa Njiru issued a stern warning that lawyers would not stand by and watch the Courts preside over the funeral of Kenya's Constitution.
