The High Court has struck out a petition challenging the constitutionality of the Finance Act, 2026 and the Appropriations Act, 2026.

• The petition was dismissed on the grounds of being prematurely filed, as the petitioners failed to first utilize the statutory procedure under the Access to Information Act to obtain attendance records.
• The petitioners, advocates Shadrack Sharu Muyesu and Nimrod Matunda Odongo, argued that over half of the MPs were absent during the crucial vote on June 18.
• Justice Patrick Otieno ruled that the core prayer of the petition—to compel the Speaker to produce attendance records—could not be considered without exhausting the information access route.
